Editorial, Fair Use & Creator Notice

Guru Checker is an independent journalistic and educational project that tracks how publicly broadcast stock recommendations from YouTube creators (the "Creators") have performed over time. This page explains the legal basis on which we reference Creators, their channel names and their likenesses, and the safeguards we apply.
1. No affiliation, no endorsement
Guru Checker is not affiliated with, sponsored by, endorsed by, licensed by or otherwise connected to any of the Creators, channels, networks, brokers, exchanges or data providers referenced on the Service. Every reference is made for the purpose of independent commentary, criticism, news reporting, research and education. No Creator should be understood to recommend, support or be associated with Guru Checker as a result of being included in the database.
2. Use of Creator names and channel names (nominative fair use)
We refer to Creators and their channels by their real or stage names (for example "Ticker Symbol: YOU" or "El Arte de Invertir") strictly because that is the only practical way to identify the source of a publicly broadcast recommendation. This is a nominative, descriptive use: we use only as much of the name as is reasonably necessary to identify the source, we do not use any Creator's logo, trade dress or channel artwork, and we do nothing to suggest sponsorship or endorsement by the Creator or by YouTube. All trademarks, service marks and trade names remain the property of their respective owners.
3. Use of likenesses (stylised cartoon portraits)
Where a Creator is represented visually on the Service, the image is an original stylised illustration (a cartoon-style portrait) created for editorial purposes — to help readers identify which Creator a given recommendation comes from. These illustrations are:
- original works authored for Guru Checker, not copies of photographs or video frames owned by the Creator;
- used in an informational and editorial context, alongside commentary and analysis of the Creator's public statements;
- not used in advertising, merchandise, endorsements or any implication that the Creator is associated with or recommends the Service.
We believe this use is protected as editorial speech, commentary and news reporting under applicable copyright, trademark and right-of-publicity law. Any Creator who would nevertheless prefer a different representation may contact us using the procedure in Section 7 and we will consider their request in good faith.
4. Use of recommendations themselves (commentary and review)
The recommendations tracked by the Service were broadcast publicly by the Creators on YouTube to a general audience. Guru Checker records short factual data points about each recommendation — the ticker, the approximate date, the price at the time and the price afterwards — and adds independent commentary, scoring and statistical analysis. We do not republish full transcripts, full videos, or the Creator's original creative expression. This use is intended to fall within the limits of fair use (US), fair dealing (UK and similar regimes) and the right of quotation for purposes of criticism, review, research and news reporting recognised under EU copyright law (including Article 17(7) of Directive 2019/790 and equivalent national provisions).
5. Accuracy, opinion and no defamation
We make a good-faith effort to record each tracked recommendation accurately and to label opinion, scoring and ranking as our own editorial assessment rather than as statements of fact about the Creator's skill, character or future performance. Past performance of a recommendation does not predict future results, and a low score on Guru Checker is not a statement that the Creator is dishonest, incompetent or unfit to give opinions — only that, on the specific public picks we recorded, the subsequent market prices behaved a certain way.
6. No investment advice; user responsibility
Nothing on Guru Checker is investment advice, a solicitation, an offer, or a personalised recommendation, whether from us or from any Creator referenced on the site. Users must not treat the data as a signal to buy or sell, and must make their own decisions or consult a licensed professional. Users also agree, as a condition of using the Service, not to harass, dox or send abusive messages to any Creator on the basis of information found here, and to indemnify Guru Checker against claims arising from any such conduct (see the Terms of Service).
7. Creator notice & takedown procedure
If you are a Creator (or an authorised representative) and you believe that a specific entry, illustration or piece of commentary on Guru Checker infringes your rights, please contact us through the channel listed on the home page and include:
- your name, the channel concerned and proof you are authorised to act on its behalf;
- a link to the specific page or entry on Guru Checker;
- a clear description of the right you believe is affected (copyright, trademark, right of publicity, accuracy, etc.);
- a short explanation of the change you are asking for (removal, correction, replacement of the illustration, additional context).
We aim to acknowledge requests within a reasonable time and to act on legitimate concerns promptly. Sending such a request does not waive any of our editorial rights, but it lets us correct genuine mistakes quickly and avoid unnecessary disputes.
8. Changes to this notice
We may update this notice as the Service evolves or as the law changes. The "last updated" date at the top will always reflect the current version, and material changes will be highlighted on the home page.
